    The key might be that your current employer should be able to give you some kind of letter that details your job duties, etc.

    If this letter can allude to the duties in your original labor that's all your attorney would need to make your case.

    Me and my husband(primary applicant) filed our I 485, I 765, and I 131. Recieved by USCIS on 06/29/2007. our lawyer recently got our reciept nos. my husband got a notice saying FP fee rejected and has been asked to re submit the fee,when, in fact all our checks have already been cashed.all of my notices say case recieved and pending.my question is ,with my husband's case in suspense, will my application be also with held or will USCIS go ahead with my application. I am the dependant spouse in this case. please respond. Thank you.

    Case Summary:
    * Employer A = Previous Employer with whom I have my I-140 approved
    * Employer B = Current Employer. I do not have a PERM or I-140 approved with this employer. I used my I-140 with Emp.A to get a 3 year extension when I transferred from Emp.A to Emp.B [So now, due to this extension, I have my H1-B approved upto Aug'08 instead of June 2006, which was the end of my H1-B six years]
    * Employer C = Future Employer. I am planning to move from Emp.B and join this Employer now.

    Question:
    Can I use my I-140 from Emp.A to get multiple 3 year extensions with Emp.C when I change my job from Emp.B to Emp.C, or after joining Emp.C ?

    [Please note: I do not have an approved I-140 from Emp.B at this time, and I have used my I-140 from Emp.A once to get a 3-year extension when I transfered from Emp.A to Emp.B. Can I use it yet again when I move to my third Employer, Emp.C or when I transfer my H1 from Emp.B to Emp.C]. This is assuming that the dates will not be current when I transfer or file for extensions.

    I got one more LUD for I-485

    ie., I got One on Mar 18th and the othe LUD on Mar 25. What dows this mean.

    Can somebody clarify...
    It seems that whenever they open file a LUD is generated, e.g.
    ..FP done
    ..FP Oked
    ..I sent docs for e-filed EAD, when they received they put a LUD

    Soft LUD is happening amounts to some activity happening with file/case.

    I would suggest to apply for the extension now and atleast carry a application receipt with you. And if you are planning to enter the county in July - Sug time, frame, I would suggest that you carry the approval notice as well.

    I had the same issue with H1B. Even through my H1B was valid but it was expiring within a months time when I was re entering US after a business trip. I was suggested by my lawer to carry the H1B extension approval notice.

    PAPPU:long time back I had posted something on ability to pay. look into the archives. Are you currently employed with this company?what is your current wage? what is the size of the company? how long has the company been in business? what has been the income in the past few years? how much cash do they have in bank? Do they have any external funding? how well do you know the owner? How many people have filed for GC in your company?

    Ability to pay is a complicated issue to be answered without knowing all the details. Remember all the data needs to be fully legal (your small time employer should not be saving taxes by using tactics that help him financially but are not right thing to do) and correct and your employer should be willing to help you with all the information. This issue is not difficult to solve. With the help of a good lawyer who knows about the intricacies of ability to pay and takes active interest in your case and a good experienced CPA you can easily overcome it.

    I am having an option of joining a new employer with whom to file LC. Company is not very big 50 employees and started in 2002.

    I am very worried about the stability of the company. This kind of companies are normal or I am just unneccessarily imagining and worrying ???

    How to check the stability of a company before you start filing anything ???

    Anybody knows about this ??

    absolutely no idea based on the info you have provided, but you need to consider a lot of things here.

    1. If its a startup building the same product 5 years later, and does not seem to be expanding/growing, its probably not going to be around much longer. If its a consulting/contracting firm that works with bigger fish, it will probably be around in the future.

    2. You need to also analyze your appetite or risk. If you are on 5th or 6th year of H1, then it could be risky. If its year 1/2/3/4 and you like everything else about this company, go ahead. Worst case they close in one year, you will have LC+I140 approved and can move to another company, restart GC, and recapture this old priority date.

    To my knowledge H1B extension is just like a new H1B application ofcourse 6 years window will be couted here and you have spent just 3 years. To me you can file H1B extension with multiple companies. But its better to file it with original company to be on safe side, onece the extension approval come ytou can trasfer it whereever you want.

    Does anyone hv gone thru this??

    My wife has similar situation, found some scars and further so many tests (sputums, broncoscopy) done and all were negative. And as a precautionary measure, she took 9 months INH medication.

    Meeting with Civil surgeon to fill out the new I693 form again with all the details as requested by USCIS via a RFE. Back in 2007 the civil surgeon just marked as abnormal xray and patient under complaint and care. So, USICS asked for the follow-up details, medication taken and a clearance from civil surgeon stating that there is no active TB and no further evaluation required.

    Will keep posted. Any others in similar situation?
