My petition was denied my lawyer and i though it was an strong case, i am still waiting for reasons why, but i want to know what is my best choice now. I had a sales contract signed to buy an wonderful business. Could i try to travel to usa with my tourist visa buy the business and try a new process requesting change of status. Could a file a new petition inmediatly. I paid for an expedite process and i think that did not help.
What are the main concerns in this type of visa for usa inmigration: Is it financial concern or what? Where can i read more about it?
Please i will appreciate any advise at all, my family is desperate, we had everything ready to go, we were very very excited in moving to usa and have the business of our dreams.

Not that I know ... the worst case scenario is that your green cards are physically mailed to you and then they are returned 'cause nobody was at the home (though normally, it should just sit with your other mail).
When you reenter US, stand in the regular visitor line.... if your card is issued, the IO will know and stamp your passport w temporary green card and allow you in the US.

I am from Ireland and its for a Multi national manager or executive. My attorney told me that form her experience it takes 4-6 weeks after approval of the I-140 as the visa numbers are current. Bit apprehensive to give the company as I dont see a need for anyone to know this info???

My previously filed PERM & I-140 are under the verge of rejection due to a pending RFE.
I am planning to file another PERM. Even though I'm trying to do it ASAP, I'm wondering whether I have an advantage on filing new PERM before Dec 20th 2007.
While applying for H1B extension in Dec 2008, If I have an approved labor/pending I-140 I thought I could request for 3 year extension. If I don't have labor/I-140 pending I can only request for 20 months extension (as my 6 year H1B term ends on Sep 2010)
I read from a site that...

When I asked this question to my attorney he said

USCIS denied my and my family's 485 based on withdrawl of old pending 140.
How did you come to know about your denial. Did they send a denial notice after you applied for EAD. Was there any status change on the USCIS website after your 140 was revoked by employer.

This morning I received USCIS email alert for both my wife and I.
My I-485 application got a RFE. "We mailed you a notice requesting additional evidence". Will have to wait for the formal letter for the details. :(
My wife's I-485 application however was transferred to Newark NJ for interview. "This case has been sent for a standard interview." :confused:
I have a ton of questions at this stage. here are few in you gurus can help me while I am waiting for the RFE letter.
1) Will the RFE letter be mailed to me or my attorney ? what has been ur experience? do you get it in one week ?

I have a question, with the current retrogression and processing dates what is the time for one to get a green card, given that the labor,I-140 being cleared within months, but what is the overall time to wait. Is the process moving forward or is there any improvement ?.

My PD is Sep 2004 EB3. If I decide to move to another employer who could also file an EB2 labor for me, how long should I wait before they could file a EB2 perm application for me?

Whn I entered US after visiting home country Nov 06, they gave me an I 94 till Dec 06 which was the end term of my first H1 B term.
i got the approval for xtension. In approval notice at the bottom, i see a new I 94 till 2009.
so now i got 2 I-94's now.
cud any body tell which is the real one.
next time whn i go out of this country, which i-94 i shud i hand it over to the officials??

Hi
We had applied for an extension of my in-laws visa, and it got rejected. Is there any way we can appeal this decision?
Also, they are here a day past their I-94 expiration. Will their multiple entry visas be cancelled? They will leave within 30 days time past their I-94 expiration.

i have a 485 filing question. i'm on EB2, ready to file for 485. however, i am in india on a family matter and will have to return only for the filing. i know it is "sooner the better", but i am trying to figure out how late i can return to US.
i have read on this forum that dates will retrogress in august. any informed people out there know how likely that is?
also, if i have to make it there in july to file 485, any idea about how long after filing i need to stay in the US before i can return back to india? i mean, any rules which say you cannot travel before such-and-such happens?

it seems that they are already married for 2 yrs....In that case she would get 10 yr GC.... The best scenario is that she should wait till she gets the card and then take whatever action she wishes to take

thanks for the info. I called the PP toll free number and was told that they will not do PP since I did not attach the original Lobor certificate with it. So I think I can expect my approval in a couple of weeks.
