ravise is absolutely right, u will get H1 for the period remaining (6 years minus time spent on L1). Also, if u file in next year's quota (filing starts in Apr 2010), it cannot have a start date earlier than Oct 1, 2010. I don't think u can start working on H1 before that date, even if u file premium.
Why don't u ask you company to file in current year's quota -- there are still visas available.

After the appeal sent by my employer, my PERM case shows status as "in-process". Does it mean it will fall under usual processing times ? Can I expect a response in the coming months ? Please let me know . I would appreciate if anyone can give some info on this.

The last report was somewhere in September 2007. Good to see that they have cleared July 07 bump in processing the 485s. they have nearly taken 29 months to clear it up.

e-file your i-140, then you have 7 business days to send in your supporting documents (receipt notice is generated immediately from your printer). I-485 can be filed before August 17
I have read somewhere that e-filed 140s are processed by TSC [which is a good thing for me because I have heard that TSC is lenient with cases like mine - 3 year degree ]

My attorney office replied back to My I485 query yesterday in the overnight post(today is the last day to respond). For the marriage proof, i attached the marriage certificate which has my incorrect date of birth. I attached the affidavit describing that there is the entry error in the marriage certificate and applied for the correction and as in process with "Registrar of Marriage" office in India. In the meantime, i received the corrected marriage certificate today with the scanned copy. My question is, Can i send my corrected marriage certificate document today to USCIS ? Will they accept with one day delay?

First, your friends father needs to find an employer who is willing to sponsor him for H1B and later for GC. Usually, all legitimate employers will have a host of immigration lawyers and counselors who will take care of things from that time onwards.
That said - now may not be the best time to try and find a job in US. Finding a H1B job (i.e. one that cant be filled locally) - is even more of a challange. I wish him best of luck.
If the person has relatives in US (is your "friend" a US citizen?) - then he may be able to "quickly" (1/2 years for immidiate relative, much more for others) immigrate using the family based immigration.

I was in a similar situation as you and had to use this firm. H1B filing experience was fine but the entire GC process and filing was not a good experience at all. There were days I had to call the paralegal and teach him the new immigration laws and that's never a good sign ! Because of their mistake I was stuck in Eb3 rather being in Eb2. May be they will deal differently with your case but have a chat with them and your company managers before you agree to use them. I m with another company and another attorney firm and they are awesome !

Hi All
I got a RFE on my Substitute 140 ( PD is 2005) where they are asking for 2007 tax returns which are not filed yet, applied for extension. 2005 and 2006 tax returns are good.
Can someone suggest me what to do in this situation.
Any suggestions or any format leters...etc

I am from PA. I am a June filer. My wife who is a primary applicant, got EAD for her and our son in the first week of Aug(after finger printing). I did not get my EAD so far. I had been to Philadelphia after getting INFOPASS appointment last week. Nothing happened there, just waste of time! It seems that there are no rules/ regulations in this system. Many of my friends got their EAD before FP. One of my friends got his GC without I-140 approval. The whole GC system is in big mess.

It will be subjective of the examining officer...he could choose to deny the 140, issue an RFE or may even just ignore it...
I understand is a grey area but i was wondering if anybody here had some issues like that. Hopefuly, whatever he does is not going to be denying it...

When will they post inventory data? I got bored with analyzing/looking May 2010 inventory. EB3 filers like me needs something to munch on for next couple of years.
