Hi,
My Company recently started Perm process and posted ads in newspaper and jobsites. We have recieved couple of resumes. One of the resume meets almost all requirements, but doesn't have enough experiance in one skill set and also doesn't have required Bachelors Degree
Do we need to do interview candidates before rejecting?

I received GC with my wife and one minor son. Other minor son's status did not change. Today I am seeing following hard LUD on my son's I-485.
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: This case has been sent for a standard interview.
On August 21, 2008, we transferred this case to our NATIONAL BENEFITS CENTER location to conduct the interview that is a standard part of processing this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. You will be sent a notice when the interview is scheduled, or if the office needs something from you. If you move while this case is pending, call customer service.
Do I need to worry? Normally for employment based adjustment of status, interview is not required. Could this be USCIS error? Do I need to do anything?

I got my visa from employer X in the year 2003 and travelled to US in jan 2004 immigration officials denied my port of entry saying employer X is non-existent and cancelled my visa and told to with draw my application and they have written 212(a)(c)(i)(i) on my passport.I went back to my home country and worked over there for 3 yrs. After sometime i got an offer from some employer Y,they have filed for my H1B and approved.
When i went for visa to US Consulate visa officer told me that am ineligible for the H1B visa. I have explained them what exactly happened in 2004.
VisaOfficer has asked to appeal for waiver using the form I-601,after my appeal to the USCIS, consulate has given the visa.I came to US in 2007 and working for same employer B .I applied for extension under the same employer B,got an RFE asking to submit aggrement b/w the client and the vendor,the requested documents are sent. After that USCIS sent NOID(Notice of Intent to Deny),gave the reason as :
In January 2004 the beneficiay applied for admission as an H1 B Worker for company X.Under oath the beneficiary stated he never signed a contract with the petitioning company X,the petition company was found not to exist. Therefore, the beneficiary was found inadmissible under 212(A)(6)(C)(I) and 212(A)(7)(A)(I)(I) and permanently ineligible for the H1 Classification.
USCIS has again came back with the same issue of my previous H1 B.
I have been in US from 2007 June with employer Y ,after going through all the process in the year 2007 USCIS has issued my visa.
Please advice me on this, any help fully appreciated.

I have my I-140 approved from Company A(Future Emp) PD 2002 and 485 PENDING . Since Visa category is current.
My current company B is asking me to apply for I-485 PD 2005 and withdraw 485 from Company A. Since PD of
Company A is 2002. I dont want to loose the opportunity. Should I join Company A/ Stick with Compamy B.

yes, I have done that. I had visa stamp of Company A and I was working for Company B. please note that the visa stamp of Company A was not expired when I entered US port of entry. At port of entry, I showed the H1 approval notice of new employer. Please make sure that they stamp the expiry date in your I-94 based on your new approval notice of Company B. that is very important.

Your Employer letter should be sufficient to support your wife from your employer,u don't need any other stuff,you can also tell your attorney about the form I-134 for Affadavit for support thats all you need,everything should be ok,don't worry be happy.

2. ..................Normally they ask for recent paystubs, but if it is within last 1-2 months it sails through well, w/o triggering RFE. Best option is to do H1b Tranfer under premium processing mode, that way in just few weeks you would know where you stand.
3. ........................ either F1 or H4 or Visitor visa.

If I understand correctly, once the I-140 is approved, the PD is fixed. Make sure you have all the details of your privious I-140.
you can take up new FT and once the new I-140 is approved and if EB2 July is current at that time, you can ask USCIS to apply that PD to your new I-140. Also the new I-140 needs to be with same or similar job duties / description.

I was laid off from company A in MAY 2002 (got salary till 31st May), later joined company B from 1st July 2002, so, I think, I was �out of status� for 1 month, later left company B because of differences on 31st October 2002 (received salary till 31st Oct ) and filed for H1 transfer with other company C on 11th November 2002, I got H1 approval on March 10th 2003, and started working with company C from April 2003 till now, so have 5 months gap between company B and C.
Was I out of status? If yes, looks like I was out out status for 6 months (5months continues plus 1 month earlier), unfortunately this comes to 181 days (june, nov,dec,jan,feb,march).
My I-94 was never expired and I went to India in Feb 2007 and got H1B stamping done and entered US with no problem.
I started my labor with current employer in May 2004 and got I40 approved as well, now filed for 485 in july rush, got EAD and fingerprinting notice, I am worried that my 485 may be denied because of �out of status� in past.
My Question:
1.Was I technically out of status and unlawfully present?
2.How does 180 days calculated? (continues 180 days or 180 days added in two time span like mine)?
3.If there was any out of status or unlawful present in past, Is it erased after lawful entry in US (I did enter in US this year after H1 stamping in India)?
4.Is Fingerprinting notice assures that everything is fine except security and criminal check?
Please help? I am really tensed after reading few forum, This will be horrible emotional set back for me and my family after 6 years in waiting if our 485 is rejected.

Now, I need to do Interfiling to link my pending I-485 to my new I-140.

(2) Who should do Interfiling- Myself or "Attorney of File" on my original I-485 or my current attorney (who did my new I-140)?

You should ask both law firms to send you your 485 paperwork, assuming you are listed as the client. they might not send you any I-140 documents, since this was the employer's filing, but the 485 documents should give you what you need. You should write to CIS saying that you are no longer represented by attorneys and ask them to send all documents directly to you. Unfortunately, CIS can be very slow in acknowledging these requests, so it is likely that correpondence will continue to go to one or both attorneys.
