Hello,
I am one of those cases where no one can get my name right. This time my visa stamp has an FNU against my first name.
I have a valid SSN, valid California DL and a valid California marriage certificate. The I-797 is not a blanket petition. It has my name as I wish it to be. I used my I-797 to get my DL couple of years back.
The question is, will the FNU create any problems at the port of entry? Will it create problems when I renew my H1-B later this year?
How would I enter my name on the I-94? As on the petition or as on the visa?

So what if DOL doesn't respond before the H1 expires..Can the Employer file for H1 Extension without an approved LCA ??
Not recommended - CIS will reject a H-1B without a certified LCA.

The employer needs to submit proof of the EIN to DOL, wait for DOL to confirm, then file a new LCA. DOL will tell the employer what EIN evidence it needs to present.

I am trying to schedule a visa appointment date and VFS website doesn't show any consulate except chennai!! can somebody please let me know what should be the reason? Last week, I was able to see Mumbai and Chennai and now Mumbai is gone! Is this because no appointments dates are available or something wrong with the website. I tried using different browsers, clearing cache, etc. but no help so far. Please help me. Will really appreciate your response.

According to TRAC (http://trac.syr.edu/immigration/reports/240/), Justice Department data show that Immigration Judges are declining substantially fewer requests for asylum. Denial rates have reached the lowest level in the last quarter of a century.
Twenty five years ago, in FY 1986, almost nine out of ten (89%) of the asylum requests in the Immigration Courts were denied. While the annual rates have gone up and down during the ensuing years, only half (50%) of the requests were denied during the first nine months of FY 2010 � a record low.
One factor contributing to the improved success of the asylum seekers is that a higher proportion of the total are represented by counsel. It must be noted, however, that the number of those seeking asylum in court proceedings has fallen.

We have a situation and need your advice on this:
We have approved I140 with company A. Company A merged with Company B, and created a new company. Our amendmant was filed for new company and is still pending. I have also a copy of my approved I140 with company A.
My I485 has passed the 180 days.and I have my EAD, and AP, and done FP.
I have an offer from different company from the same industry sector where I have been working for past many years and same job profile.
I have the following questions:
1. Can I use AC21 portability and take up the new job?
2. Do I have to wait for the amendmant I140 approval?? Or can I change with the approved I140 of company A, and 180 days past after amendmant has been filed.
3. is it true that the employer doesnt have control over pending I140 after 180 days past for 485?
Please help with your information....It will help us decide.

I've recently filed my 485.
In my labor and I140 I have my job title as ' Data ware house architect'.
My H1 says 'Programmer Analyst'. So while applying my 485 I menationed my current occupation as 'Programmer Analyst', which is different from what my labor and 140 says.Will this create any problem?
Please advise.

My mother had a sister living legally in the United States, and my parents planned to have her sponsor us for residency. Soon after landing in New York, my parents saw a lawyer. But we were told the process would take four or five years.
Coming to the States was traumatic. In Ecuador, we had lived in a house. Here, we were in a small apartment. We didn�t know any English. But you know, at that age, things change quickly. In six months we were speaking English and running around like normal kids. Most of the time, we blended in. But we knew weren�t supposed to be here, and we lived with a lot of fear.
I started acting when I was 11, almost as a fluke. One day, we went to visit our cousins, and they were on their way to try-outs for a community theater production of �Oliver!� It was through a program put on by the city, to get disadvantaged kids off the street. When we got there, the producers were like, �You should try out, too.� So my brother and I did. Then we all went to lunch. When we got home, we had a phone message that we�d both been cast. Before walking to the consulate, it is important that applicants leave their cell phones and any other electronic devices in their cars. After checking that all electronic devices and other prohibited items are left in the car, the applicants will enter the building and go through security. After going through security, they will be issued numbered tickets. All U.S. citizens should be prepared to present their passports (or passport cards if traveling by land) beginning June 1, 2009. After their interviews, a courier service, DHL, will deliver their visas within 2-3 days.
