My PD is Sep 2004 EB3. If I decide to move to another employer who could also file an EB2 labor for me, how long should I wait before they could file a EB2 perm application for me?
Suppose I apply for a position by replying to a job posting (advertisement) on monster.com or dice.com and I get that job, can the company use the same ad for applying for my PERM labor?

Me and my wife filed H1B extension through a company. I moved to consulting after my extension is approved. The consulting company filed my H1B transfer which is approved recently. Unfortunately my employer (the consulting company I moved to) dint file for my wife's H4 extension and he told that was not needed.
My question is can my wife with the petition approved from my previous employer to get her H4 stamped in India?

All,
I' am a new member and I recently read about IV group on samachar.com with regards to the flower campaign. Congratulations to all of them who could file thier I-140's and I-485's. Special thanks to all those who were involved in getting this resolution.
This is my first post and I would like to know if we can all get together and request DOS for accomodating all the pending applicants with BEC's during the October's Visa bulletin.
I know it sounds ridiculous but if you put the numbers together...currently there are around 25000 applications pending with BEC's and by Aug 17th those numbers might come down to 22,000. I' am not sure what would USCIS or DOS would gain in holding these 22000 applications back. May be 50,000 with dependents.
The best solution would be to have PD's of April'2005 for all EB categories in the month of October'07. If IV group could lobby for all the remaining applicants at BEC's, then it would be ideal for every one. Justice to all aspiring legal immigrants.
All of us can then focus our energies on other issues like Visa numbers, capturing unused visas, not counting dependents in the visa quota etc.
I hope everyone (those who have already submitted I-140's and I-485's) can support us on this issue and this should be on top of all the priorities.
Please provide any suggestions you might have on this subject.

this is my understanding but a lawyer answer but you should consult a lawyer
Since you have started your GC process and shown your intent to immigrate your F1 will be denied.
H1 is a dual intent visa ( you enter as non immigrant but U can immigrate on it) and hence application of GC has no implication on it.
Again I am not a lawyer so consult one.

There was a report on Mathew Oh's site that
some people travelled in 2008 got a messed up I-94
forms( printing bug). So whoever travelled in 2008
may want to have a very good look at their I-94 and
correct it if needed.

Correct and valid I-94 should have 11 digits of I-94 numbers. If your I-94 shows only 9 didits or 10 digits or less than 11 digits, your I-94 card is one of these million's defective cards. The agency is recalling such defective I-94 cards for replacement I-94. Reportedly these defective I-94 cards were issued at the Calgary Airport in Canada and potentially other airports as well. Those who have such defective I-94 should contact Deferred Inspection posts or any Port of Entry for issuance of replacement I-94. Defective I-94 can create a number of problems down the road unless they obtain replacement I-94.

I really like your 3rd and 4th stamps faster :) It's no bother at all. I add stamps every Wed/Fri, so it only takes me about 30 mins to get all of the stamps added up from everyone!

Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.
The 140 approval notice is not required unless this is a post six year transfer/extension.

That is correct. If your employer is enrolled in E-verify then he needs to updated your information in that system otherwise just keep the form for record.
One correction - the employer does not update anything in E-Verify. It is a read-only system to the employers to verify the authenticity of document provided by employees.

I've filed for the I-140 with EB-1 category in business, then additional evidence was requested and finally received a denial. I would like to know:
1. What are the chances to get approved after appealing?
2. If I were to appeal can I present new evidence?
3. After filing the appeal, how long should I expect to receive an answer from DC office?
4. If I ask for additional time before appealing, what are the chances that the additional time will be approved?
5. Is it better to appeal or to request a motion to reopen whenever I gather the new info to defend my case?
6. Do I have better chances if I skip both appealing and motion to reopen and focus on re filing a new case?

I had filed my I485 directly at TSC , the address which was listed on my I140 Receipt on June 25th as per the advise given by IO when i called the 800#

yes still labor transfer is possible ..But you have to very carefull.. you need to find what was companys financial position at that time when labor was filled. wheather you were fullfiling your experience as required in Labor at that time... and you need to check the companys situation if it is not blaclisted by DOL.

When submitting AR-11 form online, you will be given an option to update the address on your pending applications, this will update address on your I-485. Once the AR-11 and G-28 forms are submitted, follow up in a couple of weeks by calling customer service to verify that your records has been updated with the correct address and attorney information. Also, if possible try retaining your previous attorney for your case, this is always a safe option.
