Hi,
My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. Will they send an RFE immediately even after the I-485 has been pending for more that 180 days?
depends on the officer. A lot of officers do not know the AC21 law. As soon as they see 140 being revoked, they blindly send denial notices for 485 and you have to correct this through MTR.
After a 140 revocation by ex employer, it takes a few weeks for USCIS to act.

If not EB1, even EB2 is fine because you belong to UK and EB2 is current for you. If you claim EB1, you can easily apply in EB2 and it's "current" for you.

Any suggestion on how we can approch sending the approved LCA later and ask USCIS to match it to the already submitted H1B petition?
I dont see a problem if you have I 485 Pending ( i assume you have EAD to continue working )

They said that they were hoping that they would be able to introduce something this month , but the refuse to confirm anything . They said that the bill was still being amended and refused to give any time frame .:mad:

I'll throw in my very non-expert opinion here, having shot just a few weddings basically in your position.
The dress in the first shot is blown out. I might have angled the vertical dimension a bit lower to capture the full length portraits and avoid so much "dead space" at the top.
The composition on the second one is ok, but the eyes are rolling all over the room (bad grammar intentional). Since I've never shot in a paid position where I had the authority to exclude other photography during the group shots (not that I would even then), I generally defer first to the "guest" photographers, telling everyone to take their turn one at a time, and to speak up before the photo to get the subjects looking at them. Then I take over the attention and get everyone to look at me for however many shots I need to take of that pose. BTW, it's always good to take a few shots of each pose, because you're almost guaranteed to have closed eyes in different shots. I'm sure the pros will be in shortly to fill us both in on a better way to do this (I'd appreciate that, too). :)
The fill flash was done excellently, but the background is very contrasty and thus distracting.

I got a RFE on my Substitute 140 ( PD is 2005) where they are asking for 2007 tax returns which are not filed yet, applied for extension. 2005 and 2006 tax returns are good.
Can someone suggest me what to do in this situation.

Applied for AP/EAD/485 in July 07.....I know that I can invoke AC21 after 180 days and change jobs.....My question is ,
1. If I travel to India before the 180 days and use the AP when I return, is it like invoking AC21 before 180 days ?

I got my EB3 I-140 approval after I applied my I-485 with later PD EB2. Our lawyer sent a letter to USCIS, but there is no confirmation from USCIS. Please let me know, if there is any way to check the PD.

Since EB-1 does not need labor certification, the process is completely independent of EB-2. As such you cannot "port" your EB-2 application the way people transition from EB-3 to EB-2. You will have to apply directly to USCIS with evidence of your "extraordinary ability" in your field, such as honorable membership of professional bodies, research track record, letters from well-known people in your field etc. The first stepto convince USCIS about exceptional ability is very involved, but there on I-140 and I-485 should proceed far more smoothly than EB-2.

Hello,
I spoke to my lawyer today and she made it very clear that it is ILLEGAL to file more than one I-485 for one applicant (from 2 diff companies). USCIS will immediately ask you to make a choice.

One required initial evidence (not medical) was not included in my recently submitted 485. Is it possible to send it now without receipt before 08/17?
